When it comes to acceptable boundaries of ethical business practices within the eDiscovery service industry, are we still in the time of spurs, six guns and saddles?
Some of the world's largest companies struggle with ethical decision-making in the eDiscovery process. As eDiscovery technology evolves, so must the capacity for companies and providers to ethically manage the information and its surrounding processes and set reasonable guidelines for expectations from each other.
On July 9th, a panel of industry experts - including George J. Socha Jr., Esq. of Socha Consulting LLC and the Electronic Discovery Reference Model and Julie Grantham, Esq., General Counsel of Scarab Consulting - discussed developing model code of conduct guidelines and their relevance to both companies and legal technology providers.
Topics addressed included:- The current "lawless" state of today's eDiscovery practices
- How the Electronic Discovery Reference Model (EDRM) Model Code of Conduct Project is seeking to tame the wild, wild west
- Ideal best practices for the supervision of attorneys, non-attorneys and clients
- How to ethically manage information from records retention to metadata
